DECIDED TO SUBMIT A DRAFT LAND LAW TO THE STATE GREAT PARLIAMENT

At the regular meeting of the Government of Mongolia on May 11, 2022, it was decided to discuss the draft Land Law and submit it to the State Great Parliament.

The Land Package Law includes:

·         the General Land Law,

·         the Law on Allocation of Land to Citizens of Mongolia for Ownership,

·         the Law on Cadastre, the Law on Land Fees,

·         the Law on Land Acquisition based on Necessary Social Needs

Twenty years have passed since the Land Law was enacted in 2002, and the Land Law has been amended a total of 32 times since other laws were enacted.

 More than 60 laws in Mongolia regulate land relations through land regulations and about 200 administrative regulations, which create duplications, gaps, and conflicts in land legislation, creating confusion for citizens and the public. Therefore, a legal environment is needed to regulate new social relations.

With the adoption of the Land Law:

·         Plan new land allocation in line with long-term, medium-term and short-term policy documents for Mongolia's development;

·         To obtain comments from line ministries, agencies, citizens and the public on all levels of land management planning documents.

·         Ensure inter-sectoral coordination through integrated land planning and registration;

·         to protect the legal rights of citizens and legal entities with land ownership rights and limited land rights granted by the state, and to allocate and register land;

·         Certification activities will be organized in a transparent, fast and accessible electronic system.

There are also the following features:

·         Citizens and legal entities to acquire and trade land through the electronic land exchange

·         Transfer of land owned by a citizen of Mongolia to a legal entity of Mongolia with limited land rights;

·         use for trade and services,

·         To bring state-owned land in line with the basic rights of the Civil Code

·         Citizens and legal entities have the opportunity to transfer for a specific purpose and term, and use it on a contract basis.

·         To grant joint land ownership rights to the owners of land for public housing and multi-owner buildings.
